provides the Content (defined below) available to you on

illustrations, audio clips, video, html, source and
object code, data, and other materials displayed on,
transmitted through, or used in connection with the
Site, including for example new and existing product
information, marketing brochures, press releases,
highlights, investor information, driver downloads, and
other materials (collectively, the "Content"), as well
as its selection and arrangement, are owned and
copyrighted by Trident Microsystems, Inc., or its
subsidiaries, licensors, or business partners. Trident
actively protects its rights, including its copyrights,
trademarks and other intellectual property rights, in
the Content to the fullest extent of the law. You may
not use such material except as provided in these Terms
of Use.
You may use the Content online and
solely for your personal, non-commercial use, and you
may download or print a single copy of any portion of
the Content for your personal, non-commercial use,
provided you do not remove any trademark, copyright or
other notice contained in such Content. No other use is
permitted. You may not, for example, republish the
Content on any Internet, Intranet or Extranet site or

archive or cache without Trident's express written

Any comments, ideas, suggestions, questions or
materials you send to Trident shall be deemed
non-confidential, and you relinquish any copyright,
trademark or other intellectual property right that you
may have in what you have sent. By submitting comments,
ideas, suggestions, questions or other materials, you
further represent and warrant that the owner of such
material has expressly granted to Trident a
royalty-free, perpetual, worldwide, irrevocable,
non-exclusive right and license to use, reproduce,
modify, adapt, publish, translate and distribute such
material (in whole or in part) and to incorporate it
into other works in any form, media or technology now
known or hereafter developed.
Trademarks
The Content may include logos, trademarks and service
marks (collectively "Marks") owned by Trident, its
licensors, its business partners, and other third
parties. No Marks may be used in any manner unless
approved in advance by Trident, and/or the appropriate
trademark holder.
Privacy
Trident is committed to protecting the privacy of
information it receives from you. Trident's privacy
practices are set forth in the Privacy Information and are
incorporated into these Terms of Use.
Links to,
and frames of, the Site
If you operate a web site and wish to link to the
Site, you may link only to the home page,
www.tridentmicro.com, and not to any other page or
subdomain of www.tridentmicro.com. You may not frame or
utilize framing techniques that involve any trademark,
logo, copyrighted material or other proprietary
information (including images, text, page layout, or
form) of any portion of the Site without our express
written consent.
Driver
downloads
Trident makes available for downloading drivers for
certain of its products, subject to your agreement to
the End User License Agreement. Please see here for
further details.
Technical
support
Trident encourages its customers to contact their
computer equipment manufacturer, distributor or vendor
directly for technical support. These manufacturers may
offer technical support assistance for products still
under warranty. Trident also provides online technical
support in the form of an e-mail address to which you
may address your technical inquiries. THIS SUPPORT, AS
WITH ALL OTHER CONTENT, IS PROVIDED "AS IS" AND WITHOUT
WARRANTY. Your computer equipment, including your
monitor, graphics card, and/or audio card, may be
covered by a warranty provided by a third party, such as
your equipment manufacturer, distributor, or vendor. The
terms of such warranties vary. Some warranty coverage
may be adversely affected by following Trident's
technical assistance information. Therefore, Trident
strongly urges you to consult any equipment warranties
prior to following any technical assistance information.
TRIDENT DISCLAIMS ANY RESPONSIBILITY OR LIABILITY FOR
ANY DIMINUTION, REDUCTION OR ELIMINATION OR VOIDING OF
ANY THIRD-PARTY WARRANTY COVERAGE ARISING OUT OF OR
RELATED TO ACTIONS TAKEN PURSUANT TO TRIDENT'S TECHNICAL
ASSISTANCE INFORMATION OR ADVICE.
Interactions
with third parties through the Site
Your dealings or communications through the Site with
any party other than Trident are solely between you and
that third party. For example, certain areas of the Site
may allow you to link to manufacturers or distributors
of products containing Trident products, such as third
party original equipment manufacturers ("OEMs"). These
transactions will be conducted by the OEMs or business
partners on their sites. Under no circumstances will
Trident be liable for any drivers or other goods,
services, resources or content available through such
third party sites, or for any harm related thereto.
Please review carefully any third party's policies and
practices and make sure you are comfortable with those
policies and practices before you engage in any
downloads or other transactions on third party sites.
Any complaints, concerns or questions you may have
relating to materials provided by third parties should
be forwarded directly to the third party.

Disclaimer and Limitation of Liability
While Trident uses reasonable efforts to include
accurate and up-to-date information, we make no
warranties or representations as to the accuracy of the
Content and assume no liability or responsibility for
any error or omission in the Content. Trident has not
reviewed all of the sites linked to the Site and is not
responsible for the content of any off-site pages or
links to or from any other sites. While Trident
encourages third parties that link to the Site to abide
by these Terms of Use, Trident has no responsibility for
actions of third parties.
You expressly understand and agree that
use of the site is at your own risk. The Site, the
Content, or the results that may be obtained from use of
the Content, or the sites available through
www.tridentmicro.com are provided on an "AS IS" and "AS
AVAILABLE" basis. TRIDENT, ITS SUBSIDIARIES, AND EACH OF
THEIR EMPLOYEES, AGENTS, CONTENT PROVIDERS OR LICENSORS,
MAKE NO REPRESENTATION AND/OR WARRANTY OF ANY KIND
REGARDING SUCH MATERIALS, EITHER EXPRESS, IMPLIED OR
STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE,
TITLE, OR NONINFRINGEMENT OF THIRD PARTY RIGHTS. Trident
makes no warranty that the Site will meet your
requirements, be uninterrupted, timely, secure or error
free, or that the Site or the server that makes it
available are free of viruses or other harmful
components or destructive files. Trident assumes no
responsibility, and is not liable for, any damages to,
or viruses that may infect your computer equipment or
other property on account of your access to, use of, or
browsing in, the site or your downloading of any drivers
or other materials, data, text, images, video, or audio
from the Site.
In no event shall Trident, or any of its
subsidiaries, and their respective employees, agents,
content providers or licensors be liable for any
indirect, consequential, special, exemplary, incidental
or punitive damages including, without limitation,
damages related to the Content or any errors or
omissions in the Content, even if advised of the
possibility of such damages. Notwithstanding the
foregoing, if Trident, or any of its subsidiaries, or
their respective employees, agents, content providers or
licensors is found liable for any claim, loss, damage,
expense or other liability arising out of the Site or
the Content, such aggregate liability shall be limited
to a maximum of one hundred U.S. dollars ($100). Some
jurisdictions do not allow the limitation or exclusion
of certain warranties and conditions, and/or the
disclaimer of some types of damages, so some of the
above may not apply to you.
International Users
Trident's Site located at www.tridentmicro.com is
controlled, operated and administered by Trident from
its offices within the United States. The Site also
links to Trident's international subsidiaries' sites
located in Taiwan (www.trident.com.tw) and China
(www.trident.com.cn). Trident makes no representation
that materials or Content available through the Site are
appropriate or available for use in Taiwan, China, or
anywhere else outside the United States, and access to
them from territories where their contents are illegal
is prohibited. If you access the Site from a location
outside the United States, you are responsible for
compliance with all local laws. This Terms of Use is
deemed executed in the United States of America, and you
agree to irrevocably waive those foreign laws that may
limit the enforceability of, or render unenforceable or
inapplicable to you, these Terms of Use, including
without limitation, laws pertaining to jurisdiction and
contracts.

Trident reserves the right to change these Terms of
Use at any time in its discretion and to notify users of
any such changes solely by changing these Terms of Use.
Your continued use of the Site after the posting of any
amended Terms of Use shall constitute your agreement to
be bound by any such changes. Trident may modify,
suspend, discontinue or restrict the use of any portion
of the Site, including the availability of any portion
of the Content at any time, without notice or liability.
Trident may deny access to any person at any time for
any reason.
These Terms of Use will be governed by
and construed in accordance with the laws of the State
of California, without regard to its conflicts of law
provisions, and of the United States. You may not use
the Site or export the Content in violation of U.S.
export laws and regulations. You hereby agree that, for
any cause of action you may have with respect to the
Site, jurisdiction and venue for such action shall lie
exclusively and solely in a federal or state court
located in the state of California, U.S.A. You agree
that any such action by you must be filed within two (2)
months of the time in which the events giving rise to
such claim began, or you agree to waive such claim. If
for any reason any provision of these Terms of Use is
found unenforceable, it shall be replaced with an
enforceable provision which most nearly effectuates the
intent of the parties as reflected in the prior
provision, and the remainder of the Terms of Use shall
continue in full force and effect. Any failure of
Trident to enforce or exercise any provision of these
Terms of Use or related right shall not constitute a
waiver of that right or provision. The section titles
used in these Terms of Use are purely for convenience
and carry with them no legal or contractual effect.
These Terms of Use may be translated into other
languages for the convenience of non-English-speaking
visitors, however the English language version shall
control over any translation into another language.
